Abstract
This paper examines the role of digital feedback loops in enhancing evidence-based lawmaking in Nigeria, where traditional legislative processes have largely operated within a linear framework, characterised by limited mechanisms for continuous evaluation, public engagement, and data-driven decision-making. As a result, many laws face challenges relating to effectiveness, implementation, and societal relevance. The paper conceptualises feedback loops as iterative mechanisms that collect, analyse, and reintegrate information on laws' performance and impact into the legislative process. Drawing on lessons from the United States of America and Estonia, the paper argues that integrating digital technologies such as online platforms, data analytics, and e-governance tools can significantly strengthen feedback mechanisms by enabling real-time, inclusive, and evidence-based legislative practices. The paper uses a doctrinal and analytical methodology to examine existing legal frameworks, institutional practices, and emerging digital trends in Nigeria. It identifies challenges, including weak institutional structures, limited formalisation of post-legislative scrutiny, the digital divide, and inadequate regulatory frameworks for digital participation. The study further explores the gap between informal digital civic engagement and its limited incorporation into formal lawmaking processes. The paper finds that while Nigeria has significant potential to leverage digital technologies in governance, the absence of a structured framework undermines the realisation of evidence-based lawmaking. Consequently, the study proposes a context-specific model for embedding digital feedback mechanisms within the legislative cycle, emphasising institutional reform, legal backing, and technological innovation. It recommends adopting comprehensive legal and institutional strategies to operationalise digital feedback systems in lawmaking.
