A CRITICAL ANALYSIS OF COUNTER-TERRORISM LAWS IN NIGERIA

Counter-terrorism laws play a crucial role in addressing and preventing acts of terrorism in any country. This paper provides a critical analysis of the counter-terrorism laws in Nigeria, focusing on the effectiveness, challenges, and implications of these laws in combating the growing threat of terrorism in the country. In doing this, the author adopted a qualitative method making use of library-based materials such as books, journal publications and statutes to analyse the effectiveness of counter-terrorism laws in the country. Nigeria has been a target of various terrorist groups, including Boko Haram and the Islamic State in West Africa Province (ISWAP), which have carried out numerous devastating attacks, resulting in loss of lives and destruction of property. In response to these threats, the Nigerian government has enacted a series of counter-terrorism laws to enhance its capacity to tackle terrorism and protect its citizens. One of the key counter-terrorism laws in Nigeria is the Terrorism (Prevention) Act of 2011, which provides a legal framework for the prevention, detection, and prosecution of terrorism-related offenses. However, despite the existence of these laws, various challenges hinder their effective implementation and enforcement. This paper examines the implications of these counter-terrorism laws on the rule of law, civil liberties, and human rights in Nigeria. In conclusion, this paper argues that while counter-terrorism laws are essential in combating terrorism, there is a need for a critical review and reform of existing laws to address the challenges and ensure that they are consistent with international human rights standards.
